Your use of the screensaver
These terms govern your use of Shipwreck Cove Aquarium HD, provided by Digital Forge LLC. By installing or using the screensaver, you agree to these terms. If you do not agree, do not install or use it. An adult who can enter a binding agreement must accept these terms for use by a child.
License and ownership
We grant you a limited, non-exclusive license to use the screensaver for personal, non-commercial display on compatible Roku devices permitted by your Roku account and purchase entitlement. The app and its artwork are licensed, not sold as independently reusable assets. Except where applicable law or a separate component license permits, you may not redistribute, resell, extract or commercially reuse the app or artwork, remove ownership notices, bypass access controls or interfere with our delivery systems. Rights not granted here remain with Digital Forge LLC or the relevant rights holder.
Requirements and operation
You supply a compatible Roku device, display, Roku account and internet connection. Internet access is required to download artwork initially and again when files are missing, updated or cleared from the device cache. The cache is not a permanent offline copy or a guarantee of future access.
This is an animated screensaver. Events vary over time; promotional images may combine or highlight features that do not appear simultaneously. Seasonal banners appear on supported dates according to the device’s local date. Appearance and performance can vary with hardware and software. Follow your display manufacturer’s guidance for prolonged use; movement does not guarantee protection against image retention or burn-in.
Purchases and refunds
The price and purchase type shown by Roku at checkout govern your purchase. Roku processes store payments and administers purchase entitlements under its own terms. A one-time payment, if offered, is not a promise of lifetime hosting, perpetual compatibility or unlimited future updates. It does not authorize us to impose recurring charges without a separate purchase and your agreement.
Roku’s published general policy describes purchases it manages as final and non-refundable. Refunds or credits may nevertheless be available under applicable law, Roku’s policies or an approved remedy. For a Roku-billed purchase, contact Roku support about billing or a refund. You may also contact support@digitalforge3dp.com so we can investigate an app problem and assist with an appropriate remedy or a refund request through Roku where available. We cannot promise Roku’s decision or processing time. Nothing in these terms removes a non-waivable right to a refund, repair, replacement or other remedy.
Availability, removal and discontinuation
Store availability, installation rights, account entitlements and operation depend in part on Roku and its platform. An app can be removed from sale, suspended or discontinued because of platform decisions, legal requirements, technical incompatibility or a permitted end to distribution or service. Removal from sale does not by itself mean that an existing purchase has been revoked; continued operation and reinstallation depend on the circumstances.
We do not promise indefinite availability. Any change or discontinuation by Digital Forge LLC remains subject to applicable law, our obligations to Roku and obligations owed to existing customers. Where permitted and reasonably practicable, we intend to give advance notice of a planned permanent shutdown and explain the effect on existing installations and available remedies. Urgent legal, security or platform action may prevent advance notice.
If Roku disables the app, or required artwork delivery permanently ends, the screensaver may stop working even on a device where it was previously installed. Previously cached artwork does not guarantee continued playback. Reinstallation, a device reset or a cleared cache may also make downloads necessary. We cannot guarantee a replacement app, transfer to another platform or continued access after removal.
There is no separate automatic refund promise solely because a store listing ends. Any refund or other remedy will be determined by the circumstances, applicable law and Roku’s applicable processes. This section does not excuse us from obligations to existing purchasers or override mandatory consumer protections. Contact support@digitalforge3dp.com if you lose access.
Privacy and third parties
Our Privacy Policy describes the screensaver’s information practices. Roku’s own account, purchase and platform terms also apply. Digital Forge LLC is an independent developer; Roku does not sponsor or endorse this app. Roku and other third-party names are their owners’ trademarks.
Warranties and responsibility
Except for warranties and rights that cannot lawfully be excluded, the app is provided as available without a promise of uninterrupted or error-free use, compatibility with every device or future feature updates. To the extent permitted by law, Digital Forge LLC is not liable for indirect or consequential loss caused by use of, or inability to use, the app. These exclusions do not limit liability or consumer rights that applicable law does not allow us to exclude. They do not remove remedies for a product that is faulty or not as described where those remedies apply.
Ending use and changes to these terms
You may stop using and uninstall the app at any time. We may terminate your license for a material breach of these terms, subject to applicable law. The provisions concerning ownership, accrued obligations and legal remedies continue where their nature requires it. If a provision is unenforceable, the remaining terms continue to the extent permitted by law.
We may update these terms and will identify the effective date of the published version. Material changes will receive any notice or consent required by law. An update does not retroactively remove accrued rights or mandatory remedies.
